Agreement to Terms.

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and VIRTUAL REALITY JOBURG, doing business as VIRTUAL REALITY JOBURG (“VIRTUAL REALITY JOBURG”, “we”, “us”, or “our”), concerning your access to and use of the https://virtualreality.joburgwebsite as well as any other media form related thereto (collectively, the “Site”).

You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Intellectual Property.

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws of South Africa, foreign jurisdictions, and international conventions.

Copyright Ownership

The Content and the Marks are provided on the Site “AS IS” for your information and personal, non-commercial use only. Except as provided, no part of the Site may be copied or exploited without our express prior written permission.

Limited License

Subject to your compliance, you are granted a limited, revocable license to access and use the Site, and to download or print copies of any portion of the Content to which you have properly gained access for your personal use.

User Representations.

By using the Site, you represent and warrant that: (1) all registration info submitted is complete and true; (2) you have the legal capacity to comply with these terms; (3) you are not under the age of 13; (4) you are not a minor, or have received parental consent; (5) you will not access the Site through automated/non-human means; and (6) your use will not violate any applicable law.

Purchases & Payments.

We make every effort to display the colors, specifications, and details of the VR services, headsets, and software configurations available on the Site. All products are subject to availability.

Accepted Payments

We accept Visa, Mastercard, PayPal, and Electronic Funds Transfer (EFT) secure payments.

Sales Tax & Currencies

Sales tax will be added as required. All payments must be processed in U.S. Dollars or equivalent ZAR parameters.

Pricing Modifications

Prices for all products and activations are subject to change. We reserve the right to correct billing mistakes.

Final Sales & Refunds

Unless strictly agreed upon through custom service briefs, all sales are final and no refund will be issued.

04 / BOUNDARIES

Prohibited Activities.

Restricted Usage

You may not access or use the Site for any purpose other than that for which we make the Site available. Prohibited activities include: systematically retrieving data to compile databases, bypassing security targeting corners, using unauthorized automated bots/scripts, transmitting viruses, harassing employees, and defacing copyright or branding details.

Limitation of Liability.

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Governing Jurisdiction.

These Terms of Use and your use of the Site are governed by and construed in accordance with the laws of South Africa. Any legal action or dispute arising out of these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in South Africa.
